DIGITAL DOWNLOAD REFUND POLICY
Governed by the Australian Consumer Law (ACL), Competition and Consumer Act 2010 (Cth)
⚖ Statutory Notice Australian Consumer Law
This policy operates in accordance with the Australian Consumer Law (ACL), Schedule 2 of the
Competition and Consumer Act 2010 (Cth). Nothing in this policy limits, excludes, or modifies
any consumer guarantee rights you hold under the ACL or any applicable law that cannot be
lawfully excluded.
1. Nature of Digital Downloads
When you purchase a digital download from us, including educational resources, templates, documents, e-books, or media files, the product is delivered electronically and made immediately available upon payment confirmation.
Because digital files are delivered instantly and cannot be physically returned once accessed or downloaded, we generally do not offer change-of-mind refunds on digital products. This is consistent with the nature of digital goods and standard industry practice in Australia.
2. No Change-of-Mind Refunds
We do not provide refunds in the following circumstances:
• You changed your mind after purchase
• You purchased the product by mistake and have already downloaded or accessed it
• You found the same or a similar product at a lower price elsewhere
• You no longer have a use for the product
• You did not read the product description carefully before purchasing
By completing a purchase, you acknowledge that you have read the product description and understand the nature of the digital content you are purchasing.
3. When You Are Entitled to a Remedy
Under the ACL, you are entitled to a remedy which may include a refund, replacement, or repair if the digital product:
• Fails to be of acceptable quality (not fit for purpose, unsafe, or not durable)
• Does not match the description provided at the time of sale
• Cannot be downloaded or accessed due to a fault on our end
• Contains corrupted, broken, or missing files that cannot be resolved
• Does not perform as advertised or represented
If any of the above apply, please contact us promptly. We will assess the issue and, if a major failure has occurred, offer you a choice of a refund or a replacement. For a minor failure, we may elect to provide a working replacement file before a refund is considered.
Your ACL Consumer Guarantees Cannot Be Taken Away.
Under Australian law, it is illegal for any business to display or enforce a policy that removes
your statutory consumer guarantee rights. Regardless of any store policy, you retain the right
to a remedy for faulty or misdescribed products. The ACCC (Australian Competition and
Consumer Commission) enforces these rights and can take action against non-compliant businesses.
4. How to Request a Remedy
To request a remedy for a faulty or misdescribed digital product, please:
• Contact us via the details provided on our website
• Include your order number and a description of the issue
• Attach evidence where possible (e.g., screenshots of the error or corrupted file)
We will respond within a reasonable timeframe and work to resolve the issue. Where a major failure cannot be remedied, you will be entitled to a full refund.
5. Exclusions
No remedy will be provided where:
• The digital product has been successfully downloaded and used without issue
• The issue arises from incompatible hardware, software, or operating system on your end
• You misused or modified the product in a way that caused the problem
• The request is based solely on a change of mind
6. Legal Basis
This policy is informed by and compliant with:
• Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth)
• ACCC v Valve Corporation [2016] FCA 196 establishing ACL applies to digital products
• ACCC guidance on digital product consumer guarantees
A blanket 'no refunds' policy is prohibited under Australian law. This policy does not, and is not intended to, override your statutory consumer rights.
